Terms of Use

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the website or purchasing services operated by YS Progress Inc. ("us", "we", or "our").
By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the service.
1. Services & Scope
We provide web design and development services as described in your selected package (e.g., "The One-Pager" or "Business Pro").
- Scope of Work: The project includes only the deliverables explicitly listed on the checkout page. Any additional features, pages, or custom functionality requested after purchase will be billed separately at our standard hourly rate ($150/hr).
- Revisions: Packages include up to two (2) rounds of minor revisions. "Minor revisions" include text changes, photo swaps, or color adjustments. Structural layout changes after approval are not included.
- Timeline: Any turnaround we mention (for example, a 7-day build) is a good-faith estimate, not a binding deadline. The timeline begins only after we have received all necessary assets (logos, text, images) from you, and any delays or changes in the content you provide will extend it accordingly.
2. Payments & Refunds
- Payment: The full fee is due upfront to reserve your place in our schedule and to cover the time we set aside for your project.
- Refunds: Before any work begins, you may cancel for a refund of fees paid, less a reasonable deposit covering the scheduling and preparation already done. Once work has begun, fees are non-refundable, as time, tools and effort have already been committed to your project. If a delay is genuinely our fault, we will make finishing your project a priority and, where fair, agree a suitable remedy such as a partial credit; timelines remain good-faith estimates rather than guarantees.
- Chargebacks: Please raise any billing concern with us directly first, so we have a chance to put it right. Opening a chargeback or bank dispute without contacting us first may result in suspension of services while the matter is resolved.
3. Intellectual Property & Ownership
- Your Rights: Upon final delivery, you own 100% of the website code, design, and content. You are free to host it anywhere or modify it as you see fit.
- Our Rights: We retain the right to display the finished website in our portfolio and marketing materials to demonstrate our work. We also retain ownership of any underlying tools, frameworks, or pre-existing code used to build the site.
4. Client Obligations
You agree to provide all necessary content (text, images, credentials) in a timely manner. You represent that you own the rights to all content you provide to us. We are not liable for any copyright infringement resulting from content you provide.
5. Hosting & Third-Party Services
If we assist you in setting up hosting (e.g., Cloudflare, GoDaddy), you acknowledge that:
- We are not a hosting company. We are not responsible for server downtime, data loss, or third-party service failures.
- You are responsible for any ongoing fees charged by third-party providers (e.g., domain renewals, hosting fees), unless explicitly stated otherwise.
6. Limitation of Liability
To the maximum extent permitted by law, YS Progress Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.
In no event shall our total liability to you for all claims exceed the amount you have paid to us for the specific service giving rise to the claim.
7. Termination
We may decline or end a project at our discretion — for example, if the working relationship becomes unworkable, a client is unresponsive, or the request falls outside what we offer. Where we choose to end a project early through no fault of yours, we may, at our discretion, refund fees for work that has not yet been started.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law provisions.
